A High Court of the Federal Capital Territory (FCT) has issued a Form 48 — a Notice of Consequences of Disobedience to Court Order — against Senator Samuel Anyanwu and the Chairman of the Independent National Electoral Commission (INEC), Prof. Joash Ojo Amupitan, over alleged non-compliance with a subsisting court judgment.
The notice stems from a judgment delivered on January 12, 2026, in Suit No. CV/1050/2025, in which the court dismissed Anyanwu’s suit challenging his expulsion from the Peoples Democratic Party (PDP), thereby affirming the party’s decision.
Leaders of the PDP, led by Ambassador Iliya Umar Damagum, have maintained that the ruling remains valid and binding, insisting that it must be enforced without delay. The party leadership emphasized that the filing of a Notice of Appeal does not automatically operate as a stay of execution of the judgment.
In a further move, the PDP formally wrote to INEC, demanding the withdrawal of recognition of Anyanwu as the party’s National Secretary and the removal of his name from the commission’s official records.
The Form 48 notice, sighted by an ARISE News correspondent, serves as a preliminary step toward contempt proceedings. It warns that both Anyanwu and the INEC Chairman could face sanctions, including possible imprisonment, if they continue to disregard the court’s directive.
