Stanford’s 2025 AI Index reports a continued rise in AI-related incidents, while global regulators from the EU’s AI Act to emerging frameworks across Africa are converging on one expectation: organisations must be able to explain, justify, and evidence the behaviour of their systems. Yet many boards are still approving AI-enabled strategies without visibility into how decisions are made, what risks are introduced, and whether controls are actually working.
The next frontier of governance is not responsible AI as a principle. It is a defensible AI as a system.
A defensible AI system is one that can withstand scrutiny from regulators, auditors, customers, and increasingly, the public. It is not built on intent, but on evidence. It answers five fundamental questions: Can we explain it? Have we governed it? Are we monitoring it? Can it be challenged? And can we prove it works as intended?
Most organisations cannot answer these questions consistently today.
Consider what typically exists instead. Models are deployed based on performance metrics but without a clear articulation of purpose beyond “efficiency” or “growth”. Ownership is diffused across data science, IT, and business units, with no single point of accountability at the executive level. Monitoring, where it exists, is often technically focused on drift or accuracy while ignoring real-world impact, bias, or unintended consequences. Documentation is incomplete, making it difficult to reconstruct decisions after the fact. In that environment, risk does not just exist. It compounds silently.
For boards, the implication is direct. AI is no longer a technology risk sitting with management. It is a governance risk sitting with the board. When an AI system denies access to credit unfairly, misallocates resources, or generates harmful outputs, the question will not be whether the model performed well. The question will be whether the organisation exercised appropriate oversight and, increasingly, whether the board asked the right questions.
Defensible AI requires a shift in how boards engage. Oversight must move from approving AI initiatives to interrogating AI systems. This does not mean becoming technical experts. It means demanding clarity on purpose, accountability, and evidence.
Three practical shifts can anchor this.
First, govern for intent, not just performance. Every AI system should have a clearly defined purpose aligned to business objectives and stakeholder outcomes. Boards should require management to articulate not just what the system does, but why it exists and what risks are acceptable.
Second, assign accountable ownership. AI cannot sit in organisational ambiguity. There must be clear executive responsibility for AI outcomes, supported by defined roles across risk, compliance, and technology functions. Without ownership, there is no accountability. Without accountability, there is no governance.
Third, demand evidence, not assurances. Boards should expect clear, structured evidence of how AI systems are designed, tested, monitored, and controlled, supported by impact assessments, audit trails, and ongoing performance and risk reporting. If an organisation cannot demonstrate, with consistency and clarity, how a system operates and is governed, it has no place in production.
This is where many organisations will need to recalibrate. The instinct to move fast and scale AI must now be matched with the discipline to prove and defend.
For African boards and boards across emerging markets, this presents a unique opportunity. Many operate in environments where regulatory frameworks are still evolving but where the consequences of failure are immediate and visible. This creates the conditions to lead, not follow, in building pragmatic, defensible AI systems that reflect real-world constraints.
The organisations that will win in this next phase are not those that deploy AI the fastest. They are those who can stand behind their systems with confidence when questioned by regulators, by customers, and by society.
Because in an AI-driven economy, innovation is no longer judged by what it can do.
It is judged by what the organisation can defend.
